PANews reported on May 18 that according to The block, lawyers in the Samourai Wallet and Tornado Cash cases accused prosecutors of concealing a phone call that they believed might be crucial to their defense. In the call, senior staff at the Financial Crimes Enforcement Agency (FinCEN) hinted to government prosecutors that non-custodial agreements might not qualify as money service businesses, which are key elements of certain charges. Prosecutors in the Samourai case downplayed the charges, saying the call was fairly disclosed before the trial and represented an employee's "informal personal opinion."
Earlier news , the developer of Bitcoin privacy wallet Samourai Wallet's request to dismiss the charges was rejected, and the case remains in a legal deadlock.
