FINRA adds crypto assets page, clarifies that both assets and transactions may constitute securities

PANews reported on November 22 that according to the update of FINRA (U.S. Financial Industry Regulatory Authority) official website, it has added a special section on crypto assets. Although the term "crypto asset securities" is not directly mentioned (only mentioned in the link to the 2023 SEC investor alert), it points out that certain crypto assets or transactions may meet the definition of securities.

The new page details different types of crypto assets and how to buy and sell them, lists the associated risks, and links to resources from regulators such as the SEC, CFTC, and FTC. FINRA emphasizes that determining whether a crypto asset or transaction is a security must be based on the definition of federal securities law, and may use criteria such as the Howey Test and Reves Test.
