This exemption sets a precedent for exchanges, stipulating that enforcement action should be suspended when rules are changing and regulators cannot provide clear guidance, until regulators develop workable standards. The announcement mentioned the interruption of funding and the need to "promote the orderly functioning of markets" after a court rejected a request for a stay of execution. Cryptocurrency exchanges such as Coinbase, Kraken, and Binance may be subject to the same logic.
