SBF temporarily withdrew its motion for retrial, stating that it could not obtain a fair trial from the judge.

PANews reported on April 23 that, according to The Block, FTX founder Sam Bankman-Fried (SBF) has temporarily withdrawn his motion for a retrial. In a letter to Judge Lewis Kaplan, he stated that he did not believe he could receive a "fair trial" from the judge. SBF claimed that he conceived and drafted the Rule 33 motion while in Brooklyn jail, independently completed most of the legal research, and shared the draft with his parents without consulting a lawyer. He plans to refile the motion after the decision on his direct appeal and related redistribution request. SBF was convicted of seven counts of fraud in November 2023 and sentenced to 25 years in prison.
