Voyager Investors Appeal Dismissal Ruling, Mark Cuban and Dallas Mavericks Face Lawsuit Again

PANews, June 24 – According to The Block, investors of the collapsed crypto brokerage Voyager Digital have filed a notice of appeal with the Eleventh Circuit Court of Appeals, challenging a Florida federal judge’s decision to dismiss their lawsuit against Mark Cuban and the Dallas Mavericks. On December 30 last year, District Judge Roy Altman ruled that the investors failed to demonstrate sufficient ties between Cuban and the state of Florida, leading to the dismissal. This appeal also contests Judge Altman’s May 27 order denying a motion for reconsideration. The lawsuit, originally filed in 2022, alleges that Cuban — a “Shark Tank” investor and former majority owner of the Mavericks — along with other celebrity promoters, touted unregistered securities before the platform’s collapse. Other defendants, including NFL star Rob Gronkowski, NBA player Victor Oladipo, and NASCAR driver Landon Cassill, reached a $2.4 million settlement in 2024, leaving Cuban and the Mavericks as the only remaining defendants. Voyager filed for bankruptcy in July 2022 after facing a short-term bank run and a default by Three Arrows Capital on a $650 million loan.
