PANews reported on March 12 that, according to Bloomberg, US prosecutors stated that FTX founder Sam Bankman-Fried's (SBF) request for a retrial should be rejected because he failed to prove unfairness in the conviction process. In court documents filed by SBF himself in February, he claimed that new witnesses could refute the prosecution's charges. However, prosecutors pointed out that these witnesses were already known to the defense before the trial and could have been compelled to testify, therefore they cannot be considered newly discovered witnesses. Prosecutors also refuted SBF's claim that his case was weaponized by the Biden administration's Department of Justice, pointing out that he was one of the largest Democratic donors and that the claim that he was targeted because of his political stance was absurd.
U.S. prosecutors believe the SBF retrial application should be rejected.
