BitJungle: The 140 million case will become a classic precedent, and cases of embezzlement by insiders in the Web3 field are prevalent.

  • BitJungle highlights the prevalence of insider embezzlement in the Web3 sector, noting that even virtual currency rewards can be classified as embezzlement under current legal frameworks.
  • Judicial systems are increasingly adopting blockchain-based evidence, such as coin-mixing analysis and big data, to strengthen case prosecutions.
  • Courts now consider the real-world value of virtual currencies during sentencing, acknowledging their asset status and exploring regulatory standards.
  • A notable case involved a tech employee who embezzled 140 million yuan (converted to crypto via overseas platforms), with 92 BTC and 89 million yuan recovered through blockchain forensics. The perpetrator received a 14.5-year sentence.
  • BitJungle warns that Web3 is not exempt from legal accountability, and crypto theft remains punishable under criminal law.
Summary

BitJungle has participated in the investigation and detection of many such blockchain cases, and has also witnessed some explorations in the sentencing of blockchain-related crimes in the judicial field :

  1. In the Web3 field, there is a high incidence of embezzlement crimes committed by insiders taking advantage of their positions. Even if the reward money is embezzled in the form of virtual currency, it will be considered embezzlement. This reflects the law's precise definition and effective regulation of criminal behavior under the new economic model.

  2. Judicial authorities have begun to adopt new types of blockchain evidence, including new forms of evidence with clear directions, such as coin mixing and big data analysis, providing stronger evidentiary support for the trial of blockchain cases.

  3. The court referred to the actual value of the virtual currency market when sentencing, which reflects the exploration of legal recognition and standardized management of virtual currency as an asset attribute.

BitJungle reminds : As an emerging industry, the Web3 industry is not a lawless place. Web3 industry practitioners cannot be complacent, and virtual currency theft will still be subject to criminal sanctions.

Case details :

On December 20, 2024 , according to China National Radio, the Beijing Municipal People's Procuratorate reported the progress of the "Prosecution to Protect Enterprises" special operation and announced a number of typical cases. In one case of embezzlement, the procuratorate successfully recovered the funds involved by tracking the flow of virtual currency.

From 2020 to 2021 , Feng, an employee of a technology company, and his accomplices took advantage of their positions to defraud the company of more than 140 million yuan by means of fictitious bonuses. The suspects converted the stolen money into virtual currency through eight overseas cryptocurrency trading platforms and currency mixing services and tried to hide the flow of funds. Relying on blockchain big data analysis technology, the procuratorate successfully tracked the whereabouts of cross-border funds, and eventually prompted the suspect to return 92 bitcoins and recover more than 89 million yuan in stolen money.

On September 14, 2024 , the Beijing No. 1 Intermediate People's Court made a judgment on the case. Feng and seven others were sentenced to fixed-term imprisonment ranging from 14 years and 6 months to 3 years for the crime of occupational embezzlement, and fined accordingly. The judgment has now come into effect.
